PPE manufacturer BBF highlights OHS legal compliance

This is in light of the Department of Employment and Labourโ€™s (DOEL) proposed amendments to South Africaโ€™s health and safety legislation.

New legislation expected to more strongly enforce OHS legal compliance

From small businesses to large corporations, in all sectors of industry, companies have an obligation to set up an OHS legal compliance management programme. Coetzee says, โ€œSection 8 of the Occupational Health and Safety Act states that every employer shall provide and maintain a safe and healthy work environment. This will be enforced even more so when the new legislation comes into being.โ€

Non-compliance has consequences: Revenue loss due to production downtime and fines/imprisonment

The fines imposed on companies by inspectors from the Department of Employment and Labour for non-compliances are heavy. Coetzee cites an example of a company whose production was halted when an inspector arrived unexpectedly finding OHS anomalies. To avoid lost revenue, exorbitant fines, and possible incarceration of the responsible executive, companies should ensure that they are fully OHS compliant.

โ€œAccountability ultimately lies with the CEO,โ€ says Coetzee, โ€œSection 16 of the Occupational Health and Safety Act outlines certain duties a CEO is charged with. Itโ€™s for this reason that I include top management in my first training session. The new draft legislation, not yet published, indicates that fines could be as high as R5-million or five-yearsโ€™ imprisonment or both. Current legislation states that fines can be up to R100 000 or 24-monthsโ€™ imprisonment or both, or R50 000 or 12-monthsโ€™ imprisonment or both.โ€

Moreover, employees are also legally obligated to cooperate with their employers, to ensure compliance with duties and requirements as laid out in Section 14 of the OHS Act.
